General Terms and Conditions
1. General Provisions 1.1. Trade on "Losmados.com" (Seller) is conducted based on these Terms and Conditions. 1.2. Customers must read the Terms before registering. 1.3. Upon order submission, the user becomes a Customer, gaining rights and obligations under the Terms. 1.4. The Seller may restrict Customer rights or cancel orders/registration for non-compliance with the Terms. 1.5. The Seller may change the Terms without prior notice. New Terms are effective from the date posted. Orders placed before changes are processed according to the Terms at the time of the order. 1.6. The Seller is not responsible for any damages resulting from non-compliance with the Terms.
2. Customer Personal Data 2.1. Customers provide necessary personal data when ordering from the website. 2.2. Order confirmation is sent to the provided email. 2.3. Customers consent to the processing of their data for order fulfillment. 2.4. Personal data is used for identification, order delivery, and processing payments. 2.5. Payments are processed using makecommerce.lt (Maksekeskus AS). 2.6. Customers must protect their order information from third parties. 2.7. The Seller ensures data protection as per Lithuanian laws.
3. Purchase Agreement 3.1. An order confirmation constitutes a purchase agreement, obligating the Customer to pay for and accept the goods. 3.2. The agreement is fulfilled when the Customer pays for and receives the goods. 3.3. The agreement includes the order confirmation received via email. 3.4. The agreement is terminated if the order is canceled or the Customer’s return request is satisfied. 3.5. Each order creates a new purchase agreement.
4. Payment Procedure 4.1. Product prices are final. 4.2. Delivery fees, if any, are displayed at order confirmation. 4.3. Customers pay using available payment methods. 4.4. The Seller is not responsible for bank-related issues or errors made by the Customer.
5. Ordering Goods 5.1. Add desired products to the cart and proceed to checkout or continue shopping. 5.2. Out-of-stock items will be marked "Sold Out." 5.3. Cart contents can be viewed and edited at any time. 5.4. Quantity adjustments can be made in the cart. 5.5. Total costs, including delivery, are shown at checkout.
6. Delivery Conditions 6.1. Delivery fees depend on the destination. 6.2. Orders are processed daily.
7. Product Warranties 7.1. Products meet general quality standards as described. 7.2. Colors and features may vary slightly due to display differences. 7.3. The Seller is not responsible for quality deterioration due to improper use or handling by the Customer.
8. Rights, Obligations, and Responsibilities 8.1. Customers can purchase products at listed prices and cancel orders within 14 days if unused and undamaged. 8.2. Customers must comply with the Terms, protect login information, and update personal data as necessary. 8.3. The Seller may suspend the store, change prices and products, and cancel orders for non-payment or errors. 8.4. The Seller provides purchase documents, accurate product information, and ensures data protection.
9. Liability 9.1. Customers are responsible for the accuracy and protection of their personal data. 9.2. Customers are responsible for actions taken on the website. 9.3. The Seller is not liable for damages resulting from non-compliance with the Terms. 9.4. The Seller is not responsible for third-party advertisements. 9.5. Both parties compensate for direct losses due to their fault.
10. Miscellaneous Provisions 10.1. Information from "losmados.com" cannot be copied without written permission. 10.2. Terms are governed by Lithuanian law. 10.3. Disputes are resolved through negotiation or in court if unresolved.
